I wanted to attend but I have pretty much exhausted all my vacation. 2 more days will be pushing it.
Also, the flight schedules to fly from Portland Oregon to D.C is so ridiculous that it takes a whole day away in flying.
Will definetely attend a rally in the east coast, or better yet will help organize one.

the world is not fair, I am willing to fight my part to make it fair and just for all.
Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.
Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

Personally, I feel state chapters is a not-working concept. Having bigger chapters like TriState, Midwest... and better still 'East Coast chapter' is a face saver until we have sufficient numbers. There should we a minimum threshold say 40-50 [I'm keeping it low] members to sanction a state chapter.
I question why there should even be a MI chapter, when there are hardly 3-4 (am I exaggerating?) active members and the newsgroup is dead for all purposes? It's depressing and demotivating. We are better off in bigger regional groups until we have sufficient numbers to justify a chapter [ supply to follow demand, and not vice versa].

Frist, sorry for the confusion. I do have a 05/2007 PD at Atlanta PERM center. I came to the country in 1999 for grad school, started working with OPT in 2001, converted to H1 in 2002, laid off in 2002, started working again in 2002 with a new employer, filed labor in 2004 and got stuck in BEC ever since. The employer refused to file PERM, so I had change to a new company in 2006, and had PERM filed in 2007 and got stuck there again. Your are right, I am technically not in BEC, but psychologically I always feel I am in there.
I did not know what was 'disruptive' and 'inappropriate' about what I said. This is a board for BEC victims, so BEC victims are not allowed to express our frustration? I just expressed my depress and my concerns over how much this will retrogress the PD without targeting anyone. When tons of people run in front of our queue and shut us out in cold, we are supposed to 'enjoy the moment' with them? If so, when USCIS said no one can file 485 on July 2nd, why none of the people enjoy the happiness with those who already filed, because that will make their processing time much faster. People said we should feel happy for those who can file, because they now can get EAD/AP for their spouses, as if our spouse do not need EAD/AP. And as a result of this total mess, I don't think we'll have hope in another several years to see the date current.
IV core keeps telling us, BEC is always on their agenda. Really? If they did not even understand our pain and consider our frustration a disruption to people's happiness, how can we expect them to help? I still think IV is a great org, as it's the first such organization to speak out for legal immigrants. But when it comes to BEC victims, I did not see IV changed anything, or intend to change anything.

May I ask where you got the 90K number from? I saw "12K unused last year" floating around.

Now that CIR is defeated again for nth time, We really need to consider rethinking about our stratergy,
I guess we are about 15K membership and if we include spouse and take a guess every one in five has dependent kid to join (wild gusstimate) we come close 35-40K approximately.
most of us are legal and we should not having any issue in getting Green card with current law only if backlog is cleared and we recapture visa numbers.

We need to spend more energy in researching possibility of recapturing 90K visas and we will be done,

chaanakya, why do you have a problem with the donors? if you don't want to make any monetary sacrifice that's fine...nobody's complaining. Now it's only fair that you don't complain when people making additional sacrifice are given some recognition. Don't mistake...those donors also make all other forms of non-monetary contributions. In this big black hole we are alone, not the govt. nor the lawyers really care for what goes with us. USCIS is just a money making machine for the govt. Rules are made complex and there are several layers of forms. I wonder why a person should go thru 2 stages before filing for I-485. Or why they have 5 different forms filled Labor/I-140/I-485/I-760/I-131 blah blah blah when they could just do it with 1 form like any other country have or may be 2 layers, labor and I-1485. There's no logic of having to file I-140/I-760/I-131. It's all money game...

Thank you all for the quick and helpful replies.
My current employer has assured me that they will not revoke my LC or I-140. It is a huge company and I think it will stick to its word. It will not have any use for the LC, I-140 anyway as the whole group was laid off and the product moved to India.
So, it seems that if I transfer to company B they will be able to file for an H1 extension beyond 6 years based on I-140 approved with company A. I can then start my GC process with B again while keeping my old priority date.
Once again, all your replies were immensely helpful.

Dear Folks, I have a question:
For example, if someone's Advance Parole document validity is terminating on (say for ex), July 16, 2009, then, should the person apply for renewing his/her application prior to July 16, 2009? In other words, should a person's application to renew his/her AP document be made prior to the termination of the current one, OR, could this application for renewal be made after the current AP document's validity expires (in this case after July 16, 2009)? USCIS accepts AP renewal applications 120 days in advance of expiring AP. The normal processing time for AP is approx 1-2 months (usually it is about a month). Keep in mind that the new AP which is issued will have an immediate effective date from the date of issue and the start date will not be from the expiry date of old AP. So in most cases you will end up losing some days or even months. If you do not forsee any immediate need to travel you should wait till 30-40 days prior to old AP expiry and then apply. If your travel plans are unknown and you may have to travel if an urgent situation arises, then you should apply 120-90 days in advance to make sure you have AP validity at all times. You will obviously lose some days or months... but then who says everything that USCIS does is fair :)

Subject: Injustice :mad: for people with priority dates in '02, '03, '04 etc. who are still waiting for their labor certs to be processed using the traditional process - we want to file a case against DOL's lethargy - Let us join together and file a case against DOL and bring justice to this unjustified system.
The manner in which the backlog reduction center have been processing the
labor certs seems to be very unfair for people like me and others who have been affected. I know of cases with priority dates as late as 2005 that have gone through the traditional process and have been approved already. And there are cases like mine and others with much earlier priority dates that haven't been done. This is very unfair and unjustified. It is like we have been standing in the queue for several hours and a person who came much later than me just sneaked into the queue and got his service done while I am still waiting for my turn. Also the fact that now the UCIS has made the filing of I-485 current adds more insult to the injury that I and others in my position have endured.
The fact that the I-485 was made current and then withdrawn was made a big deal and people wanted to file cases, whereas the plight of people like me who are still waiting for the labor cert to be cleared has been totally
ignored, inspite of the fact that people who applied for labor much later
have been approved through the traditional process.
We want to file a case ASAP with the DOL or other relevant
authority regarding this issue and the unfair way of the process that we
have been subjected to. So can all those folks who have been affected by this join and voice your support? We shoud put up this fight because this is in no way justified. Why would it be?
The next steps should be:
- Get all of the support we need from all affected folks ASAP
- Get in touch with a lawyer who can help us to prepare the case
- File the case in a court against DOL

Every airlines has its onw set of issues - u will get the pinch only when shit hits the fan. My bags were stranded in Dubai and when I reached Chennai I had nothing with me except a small bag with no clothes.
The agents told me - if you have Indian passport then Emirates will give you $$ compensation per day but if you have American passport Emirates will give $$$ per day. They reimbursed me for 2 sets of clothes and shoes and $50 per day for three days because my bags arrived one by one on the third and fourth day after calling them everyday and pressurising them. If we did not call them - the bags would come slower than that. In Dubai the bags were in hot sun and I had choclates inside and somehow the cover broke and choclates melted and seeped through and a I think you all can imagine how it is.
What I am saying is - things are good everywhere unless we get into issues. Things were good until Retrogression hit us here. Now we complain about difference in treatment - but earlier wenever complained.
What I am saying is - when dealing with things outside of your home country - you cannot expect or assume fairness to you.
I would submit that this is far more discriminatory than Air France or any other airline flying via Europe. The European carriers are bogged down by their country's immigration policies, it seems. I flew Air India via Frankfurt once and the German security officials had all Indian passport holders (not possessing a Schengen or transit visa) quarantined in a separate holding area with inadequate seating and restrooms for the hour-and-a-half layover. I can imagine the frustration that would have ensued had there been longer delays.
However, unequal compensation for troubles caused by the airline is entirely a different and unacceptable matter. It is discriminatory and I'm sure it violates some international mandate somewhere.
I disagree that because you are outside your country, you cannot expect to be treated fairly. Unless they have a solid evidence that you have broken a law, they should not treat you any different than any other person.

What I am saying is - things are good everywhere unless we get into issues. Things were good until Retrogression hit us here. Now we complain about difference in treatment - but earlier wenever complained.
What I am saying is - when dealing with things outside of your home country - you cannot expect or assume fairness to you.
I would submit that this is far more discriminatory than Air France or any other airline flying via Europe. The European carriers are bogged down by their country's immigration policies, it seems. I flew Air India via Frankfurt once and the German security officials had all Indian passport holders (not possessing a Schengen or transit visa) quarantined in a separate holding area with inadequate seating and restrooms for the hour-and-a-half layover. I can imagine the frustration that would have ensued had there been longer delays.
However, unequal compensation for troubles caused by the airline is entirely a different and unacceptable matter. It is discriminatory and I'm sure it violates some international mandate somewhere.
I disagree that because you are outside your country, you cannot expect to be treated fairly. Unless they have a solid evidence that you have broken a law, they should not treat you any different than any other person.

anyways - nice to hear a good speech especially seeing face on video. thanks logiclife for your effort and taking your time make this video for those who doesnt understand other than accusing and finger-pointing. good night.
