Consequences of the
National Origins Act
The goal of the National Origins Act was to control
both the quantity and quality of U.S. immigrants in an
effort to prevent further erosion of the ethnic composi-
tion of U.S. society. The law accomplished this goal
using three mechanisms: capping the overall number of
immigrants allowed into the United States in a given
month and year; favoring immigrants from certain
countries; and screening out otherwise qualified immi-
grants as unsuitable to the United States during the visa
screening process. The sorting mechanism heavily
favored northern and western European countries. The
temporary formula of 2% of the foreign-born of each
nationality in the 1890 census gave 85% of the quotas
to northern and western European nations. The national
origins system fully implemented in 1929 continued
the trend of both overall restriction and nation bias.
Indeed, the act virtually halted all immigration from
southern and eastern Europe. Thus, European immigra-
tion dropped from more than 800,000 in 1921 to less
than 150,000 by the end of the decade.
In addition to controlling the volume of immigra-
tion from Europe, the National Origins Act also
allowed a mechanism for selection of immigrants as
well. In its creation of consular offices abroad, the act
provided a frontline screening mechanism for select-
ing out those deemed unsuitable for the United States.

The Supreme Court has defined these levels of scrutiny in the following way:
Strict scrutiny (if the law categorizes on the basis of race or national origin or infringes a fundamental right): the law is unconstitutional unless it is "narrowly tailored" to serve a "compelling" government interest. In addition, there cannot be a "less restrictive" alternative available to achieve that compelling interest.
In Bakke, the Court held that racial quotas are unconstitutional, but that educational institutions could legally use race as one of many factors to consider in their admissions process. In Grutter and Gratz, the Court upheld both Bakke as a precedent and the admissions policy of the University of Michigan law school. In dicta, however, Justice O'Connor, writing for the Court, said she expected that in 25 years, racial preferences would no longer be necessary. In Gratz, the Court invalidated Michigan's undergraduate admissions policy, on the grounds that unlike the law school's policy, which treated race not as one of many factors in an admissions process that looked to the individual applicant, the undergraduate policy used a point system that was excessively mechanistic.
In these affirmative action cases, the Supreme Court has employed, or has said it employed, strict scrutiny, since the affirmative action policies challenged by the plaintiffs categorized by race. The policy in Grutter, and a Harvard College admissions policy praised by Justice Powell's opinion in Bakke, passed muster because the Court deemed that they were narrowly tailored to achieve a compelling interest in diversity. I entered US on H4. Then applied for H1 for software job. worked for 2 months last yr and then went for maternity leave.
Now I started working again and I still have to go for stamping.
I have completed CPA and I would like to move to an accounting firm ( they have to file my H1 transfer with accounting domain).
Is this going to cause any problem during H1 transfer or stamping??

I have many positive experiences with Fragomen.
My RIR case was first filed in 2001 by a different lawyer and he screwed it up. It got rejected by DOL and bumped back to non-RIR. When the BEC was about to take the case for processing, my company hired Fragomen for the processing. Fragomen reviewed my case, worked with me, prepared and filed a new Labor petition in 24 hours as I was reaching my 6th year limit.
When PERM was introduced, they worked with me to convert my traditional labor filing to PERM.
During the July VISA bulletin fiasco, they kept communicating well and worked overtime (I used to get emails around midnight sometimes) and filed my case. They even followed up and made sure that I was going to attend my finger printing appt when they got the courtesy copy.
They do well with email replies. I have never called them and hence, not sure about responding to calls. But I never had a requirement to call them as they normally reply to emails within 1 working day.
Since Fragomen is so big, they might have a small percentage of attorneys / para legals who are not customer focussed. I have dealt with 3 different attorneys / para legals withing Fragomen, and I have high regards for them.

Hi,
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.
Here are my questions.
1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?
2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.
3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.
4. Another suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

EB3 porting is a loophole like labor substitution.
when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.
Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.
How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

I read and understood the whole paragraph with both "published" and "Hidden" messages what you wanted to convey. If you do not see much activity on your state forums, why do not you take the lead to reverse the course? That would be the right direction rather than suggesting to change the skeleton. Do you blame yourself (Since you are claiming yourself a member)for not having much activity in your state level? If not then problem lies there and that is my hint to you.

Yes, it is. I think, we need to start a separate campaign for EB3. Most of the stuff IV has been doing is geared towards helping EB2. Look at all the analysis and predictions threads. It looks like EB3 doesn't exist.
