    what makes you think people participate in those? from personal experience
    in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
    ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...

    This post does clarify visa recapture issues, but what about concurrent 140/485 filing ? Also, if our fate is still so tied up with 12+ millions illegals, doesn't that mean that we failed to make our case, even with so much media coverage, lobbying and our personal efforts to call the law makers. Could another explanation be that lawmakers have all but refised to treat us with dignity we deserved as an educated, law abiding, tax paying citizens contributing to the society. I believe that we didn't fail and we tried what we could but still lawmakers refuse to act on our casue, may be they are implying something without explicitly saying it ?

If no immigration provision has passed in more than last one year, does it mean that all those organizations are also ineffective? We all know that this is a world of instant gratification but please understand that there are groups who go to DC to get their issues addressed and they wait for 2, 3 -5 years before anybody would start listening to their issues. You see, just to explain using an analogy, Microsoft is working to get H-1b numbers increased long before Immigration Voice started. If Microsoft has not been able to get Congress to increase H-1B numbers, does it mean that Microsoft is no longer an effective corporation? Likewise, Immigration Voice has made significant progress but due to the political climate and statistical discussion about the undocumented, which of�course is different but an important issue, our provisions are clubbed in the comprehensive bill. If it would have been any other year when Congress was not considering the issue of undocumented or comprehensive immigration reform, advocacy effort of Immigration Voice would have definitely translated all our provisions into law six months back.

    If you want us to get Visa recapture as interim fix, allow me to share with you that as it stands today, it will not happen outside of Comprehensive bill. Infact as it stands right now, even H-1B increase will also not happen outside of comprehensive bill. Reason? Most of the groups and companies have stopped pushing for temporary relief because any kind of temporary relief or interim relief chips away support from CIR and the offices of Senate and House Leadership along with other proponents of CIR have made it clear that any immigration relief has to be a part of CIR and not outside of it. Other companies/coalitions have stopped pushing for temporary H-1B increase as they do not want to be in the bad books of committee chairmen and the leadership offices by trying to sneak temporary relief that divides the supporters of CIR. Leadership wants support for CIR and want all sides to wait for CIR. And not doing so and trying to get interim relief before CIR would put them in bad books of Senate and House leadership, which no one wants coz if CIR fails, then after CIR, these offices will not co-operate with any group that tried to take away support from CIR. So it would be counter-productive politically to do things that take away good stuff from CIR. Also, if you think that any effort in the final week could help in anyway, then let me to share with you that most provisions and their language are decided much in advance and last minute efforts almost never yield any result on the Hill."

    SATYAGRAH is an Excellent idea.One day hunger strike near Capitol hill will give enough media attention ! I think it is legal to protest in a peacefull way. It is much better than rally ! I am ready to participate in SATYAGRAH in DC !

    Keep aggressively working on SATYAGRAH (insist for truth) to end retrogression. If nothing happen in lame duck session, I would suggest to gether at DC (may be 50-100 people) and have one day hunger opposition. One person can dress like Gandhi to attract attention of media. Send one flower and picture of Gandhi to all Congree members with just one line message and it can be repeated every week.


    Might wanna get a REALLY strong woolen shawl for the guy playing Gandhiji, if we're doing it in winter ;)

    Just a question, how is this so called "Satyagragh" going to work? We fast and stand outside the white house protesting?

    I dont mean to discourage folks here...

    But here is what I have seen more often with MBA. Techies like programmers, business analysts in IT sector have done their MBAs from good schools and ended up doing the same job EVEN WITH GREENCARDS.

    I have seen GC holders doing MBA and then after finishing MBA ending up with same job description with a 5% increase in pay.

    So please do your research in HOW MBA is going to help you in your situation. Your job and your INTENDED JOB POST MBA may not really need you to have an MBA. And I have seen this way too often. So think before you pluck down 30,000 dollars on a degree that might do little benefit financially after you complete it.

    I would not agree with your interpretation. You are insinuating that a majority of the EB based green cards sponsored by employers are similar to family sponsored green card and also that people are favoured for their nationality.....how did you arrive at this conclusion?
    Possibly your exposure may be limited to mom and pop shops and that may be the basis of your analysis....!!
    Working in a "regular" company and having the authority to hire people in my department, "nationality" thoughts have never crossed my mind....!!!


    Everybody is entitled to their opinion. It's pretty much an open secret that staff augmentation firms (which take up a pretty good amount of h-1 and GC) are involved in nepotism and filing for their own country people.

    Yes, it was a major let down. We were hated, cursed, some members lost morale - but everyone who worked hard - did work very hard. We kept changing strategies based on situations trying to see if people will come - we did every little bit we could.

    I am still trying to revive the chapter - some new members are active like laborchic and dressking and offcourse our Tri State volunteer team has always be trustworthy.

    Once again - I know a lot of people do have genuine reasons and you must communicate.

    Here's what they got that we don't

    1) Numbers - 12 million new voters indebted to them for life, is too hard for some national-level politicians to resist

    - We are barely 1 million. Given we are "highly-skilled" most of us never likely to vote in elections (to avoid jury duties)

    2) Strong support from US Citizens who vote for ethnic reasons. Whether anyone likes it or not legalization of "undocumented" has become a ethnic issue. More powerful than our international/global approach, because there are 25% of US population belong to that ethnicity ( and they also vote in greater percentages than the natives)

    - Chinese/Indian/Phillipino/others USC/LPRs communities are miniscule in number. And most of them don't give a you-know-what.

    3) They have the strongest Motivator - FEAR - it's a matter of 'survival' and not just pursuit of happiness like us. God forbid, we go back to our countries we won't starve there. These guys don't have any jobs in their countries and will be living in abject poverty . They risk death in the desert, whenever they go for vacation back home. Cops, criminals, USCIS, abusive Employers, Nativists - everyones at their back. Some of them are married to US citizens/LPRs. They face the prospects of getting separated from their families.

    - We don't have such a strong motivation. If let's say there was a NumbersUSA sponsored bill to bring all legal immigration down to 50,000, believe me, DC would've been swamped by protesters. We may have met, even exceed initial projection of 10,000 participants. You'd have seen a true multi-ethnic protest respresented by every nation on the Atlas.

    4) Money is not a problem for them. Many of them are paid off the books and have never paid Income Tax, SS Tax etc. There are also very strong political organizations, PACs (Political Action Committees) supporting. There are many USCs/LPRs contributing to election campaigns on their behalf.

    - We pay all taxes. There is no PAC supporting the cause of EB immigrants exclusively ( ImmigrantsList is a PAC that supports all immigration including "undocumented").

    Unless a LPR starts a PAC ( Aman?) starts collecting funds from other former-IV LPRs and US citizens and starts campaign contributions we continue to have a limited voice ( paying a Congressmans election campaign is will catch his/her attention more than paying a lobbyist to talk to them)

    So it's not them having many negatives. It's us EB immigrants who face the strongest odds.

    Just an analogy please dont think i am against undocumented fellows.. They are definitely facing a bigger problem than us!
    Compare the following
    Nondocumented vs. Documented Legals

    1] Not well educated / Highly Skilled
    2] Not much computer savvy / Mostly everyone should be
    3] Not have enough resources to advertise their struggle!
    / Trying all ways to advertise & campaign
    4] Do not have enough monetary collection to run a rally / advt /
    set up a website
    / Have some collection to do the basics

    5] Come here illegally and yet have the courage to demand a legal status openly...
    / Feel shy or sorry for demanding a legal status soon! (for those who dont think
    this is worthwhile)

    Inspite of all these negatives , they have grouped up so well ! highly commendable. I dont know what we can learn from them, only that they are all in the same boat , but we are in different ones .. as some have got gc, some have got receipts, some are ready to wait as they have just applied, some are just not interested!!

    In fact a fellow indian wearing a turban tried to get into the consulate just before the consulate officially opens. The person inside (not the security) threatened him that he/she will call security and through him out!. Thats their attitude... They (at least think) belong to ruling class of india, so they behave like that?!

    Why was your "fellow Indian wearing a turban" trying to enter the Consulate before it officially opened? The Consulate official had every right to call security and "through out" your "fellow Indian wearing a turban". If your "fellow Indian wearing a turban" had followed the rules and not tried to force his way, maybe he would not have been treated thus.

    Here's a thought: try doing the same here and see how well you are treated.

    ... I have seen a few threads in the past where someone stuck in BEC was just venting and then ppl come along and tell them to "be happy for others". I don't get it....

    Come on, man. We are paying too much attention here. Look, there is always somebody stuck somewhere. People are stuck in BEC, in other contries. People are stuck in Afganistan, Bangalore, there are hungry people stuck in Africa. So? If there are hungry people, then I can't enjoy my dinner then? Someone always has to come and say "you enjoy and there are people stuck somewhere"? What's your reaction would be if someone come on your wedding and start complaining that he is impotent? - these are a little extreme examples, just to make a point.

    I'm a June filer, and this July thing will hit me too, but I still congratulate those July filers. So what? I understand that we will start getting our EADs in a year (so we would be applying for next EAD once we got current one). I understand that USCIS officers will be irritated and pissed, they will be under tons of application and everybody will be calling and bugging them. So? I realize that it maybe will take 3-4 years for us to get GC. So? I realize that DOS might retrogress now dates for many years on Oct, and will not do the same stupid mistake as making dates current and unleashing the voluntary slaves. So?

    Today was little tiny success and it was day of tiny celebration. There is day for complaining and there is day for celebration.

    If you have plans of doing an MBA in future, then Canada would be a better option than US. Otherwise as uma001 points out, doors are closed for most professions except 38 occupations.

    H1bslave, in your case your PD is Sep 5 EB2. I see something in the distant horizon. PD of 2007 and beyond or EB3-India I see no hope.
    Atleast you can survive on a lifeboat called EAD and AC21.

    Note that list of occupations changes constantly. I lived in Canada for 20 years after coming as PR on point system. It works well there, if you think money is not everything. Education is equally good. People, of course are far nicer and friendlier. Even border immigration and custom staff show a friendly face and attitude..

    This is in response to vldrao's and delax's calculations...
    Are you people 'creating' new quota rules?? what is this 7% with regards to any category? 7% is the per country limit including all categories. EB1, EB2, and EB3 gets 28.6% each, out of the total available 140,000. This means each country will get 2802 visas for each of these three categories. However spillover can be redistributed to lower categories and to oversubscribed countries.

    prince_charming, you had mentioned that you had done H1 transfer with AC21.
    I think it was mentioned in one of the posts in Murthy site that such a situation could lead to denial of I-485 as it would constitute abandonment of AOS application. One should use EAD after filling AC21.

    I recently talked with my lawyer and also took consulting (paid $$$ for hourly consulting) with another lawyer as I am going thru the same route. Both the attorney mentioned there was no problem doing ac21 for H1 while AOS was pending for > 180 days and 140 approved .

    So what do they really do at work ? do nothing and get the pay check ? no wonder banks need big loans from government

    I have seen two guys (different project and client) from particular state, removed from the project because of their communication...They were also bad in programming and thats different story.
