I just filed i-485. My pD is Jan 2004
i-140 has been previoulsy approved. I was laid off but my original employer agreed to give me evl, but with the way the economy is going they are not doing well.
I have another employer which I am working now with.
How likely is to get an approval (or an rfe for paystubs?) before 180 days.

my earlier post was not meant to be offensive regarding your interpretations of the bill, I apologize if it came across that way.
rather my post was meant to challenge your interpretation in the common interest. however after seeing your response i did look up the bill text and agree that the provisions on the Section 405 (e) seem to apply to retroactively to all who would have been in such status if the section was in force when the graduated.
My earlier comments were based on Bill Frist's own summary of his bill and not any third party's. however the summary does not mention anything about the retroactive nature of adjustment of status under f-4

My 2 cents to this discussion.....
Progress of IV and processing of papers cannot be stopped. I want to be able look back and tell my son that I was there on that day. To me this rally was equal to the "I dream" march by Dr. King in the context of American history. If we do not set these examples then who will.
Those who did not make it and see the point now will join us as we go along. There will be more of this as we go along. Everyone will get a chance.
I propose that we organize rallies in most major cities on the same day. This will give a chance to all those who wanted to be there but could not make it. Maybe the local chapters can take this up.

If we fight we lose once, if we do not we lose every time we don't. IV has nothing to lose if it can at least talk to a very good attorney. I'm not a lawyer but there could many ambiguous statements in it, and good attorney could make use of them to fight.

We have asked for "sorting by priority date" (updated first post with original letter to USCIS), so we should get the breakdown if we can define "priority date" for them.
What we get
1. We get number of EB2,EB3 Primary and EB2,EB3 Dependent applications.
2. From the wordings, I won't be suprized if they give a summarized number from 2001.
But if someone else requested this info broken into PD buckets by month and Year, then I think we need to use that. The letter I sent had that wording, but I never received any response yet.
Here is what we don't get

To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.
To sri1309, I never meant to digress from existing items on IV's agenda. All I am saying is that the backlog might get cleaned up a bit if we are able to assist in weeding out fraud cases.

So you reminiscing about your uncle and aunt(when H-1B never existed), and now talking about "masses" makes no sense. So don't make a U-turn on your chosen path.Now quota has reduced and hence the struggle for H-1B visas.
And who is talking about H-1B visas here, yes they are a privilege and not a right. iv is meant for people who have been sidelined due to unfair laws governing issual of GC's.It doesn't have anything to do with H-1B visa program and desi comapanies who misuse it.

We are USCIS's cash cows we'll have to give them milk until the last drop....It was a well thought provision as they knew they'll earn more money in yearly AP/EAD renewals then they were earning in H1B renewals. We are very interested in this provision. Immigration Voice has heavily invested in this measure, both, legislatively and administrative. We have consistenly advocated for this provision which we believe will curb arm twisting by bad employers, that are like few bad apples in the big basket. Such a provision will help everyone including USCIS, lawyers, genuine companies, and direct+indirect beneficiary. Its a win-win for all.
