I want to talk about this issue from my perspective.
I got my M.B.A in a prestigious US university and worked as a Financial Analyst in US for two years. I was thinking of applying for GC at that time because I had planned to stay in US. But, that winter, when I took a vacation in China, I decided to look for a job in China because I was very impressed by the economic development in China and wanted to capitalize on the opportunity. The Chinese market was/is in urgent demand for US-trained financial analyst. After some interviews, I got a very generous offer from a multinational company and quitted my job in US without any hesitation.
Now five years has passed. Because of my excellent performance, I get two promotions in the past five years and am a director in my company. My boss, who is an american, lost his job and has to go back to US because my company cannot see any fiancial advantage to hire him anymore. I have never been happier. I believe that I made a very good choice five years ago. Most of my chinese classmates during MBA study are still struggling for their GCs and get stuck in their career development because of GCs. They are quite regret that they did not come back to China back 5 years.
So what I want say is that, US is not a very good place to stay anymore. There are many golden opportunities in your own country! Many countries are becoming stronger and stronger. It's not 10 or 20 years ago. 10 or 20 years ago, US is the best place in the world to stay. But now, it's different. My friends in US make about $150k a year and cannot afford a luxury lifestyle. I make $100k a year and enjoy a very comfortable life in China. I built my own house in China, which is even better than my house in New Jersey before. I hired my own chauffeur, housekeeper, two nannies for my baby... I cannot afford these thing if I were still in US. How many americans can afford the same lifestyle as mine? I don't think there are many.
My point is, be open to opportunities in your own countries or other countries in the world other than US. You will be happy to leave US several years later when you look back. Besides, if more and more US-trained scientists and professionals come back to their own countries and help their countries to develop, maybe in another 10 or 20 years, no one would want GC anymore."

Mark, point taken but I do believe if we can raise some stink then we should. The Law firms need to realise that the country club memebership is coming at the cost of some poor sap stuck in the immigration rut and all he/ she needs is kind words and sound advice. I shall stop my ranting about Fragomen after this post.
On your other point about law firms participating. What makes you think they already do not have a member in the forums. If they read this good then the messeage has been sent across.
If approached in the right way there is a chance that big law firms will be helpful to us. The way to do this is politely, not raising a stink, with a credible number of their clients supporting us. The big law firms could act as a "force multiplier" to use a military term, only a small fraction of the community currently know about us, the big law firms and USCIS are the common connection for EB GC process, and USCIS is not about to email all their customers about us. With the right encouragement law firms might just help.

Like me most of us would have got the reply from the Senetor or the congress man for the email that we sent. But all the replies are generic in nature and focus is on illegal immigration issue. The problems of "Legal immigrants" to my knowledge did not get their attention?. This is my observation.

That is correct. The responses at most times will be generic on the subject of Immigration. Sending them hundreds and thousands of emails will work as per our advocacy strategy.
You may want to do a couple of things.
1. Call up the lawmaker office now and thank them for responding to the email.

2. Come to DC to take part in the advocacy day event. This is your opportunity to take your emails a step further and now talk to the staffers. Emails are good to create an awareness. Now it is time to step it up further and make an impact that will be thousand time greater via face to face meetings in DC with the lawmaker office. Meeting in DC has more impact than say meeting in your state local office of the lawmaker.
Nevertheless keep sending emails daily so that it helps generate awareness in every lawmaker office and help us in the next steps of advocacy.

Countrywise visa allocation limits contradicts Equal Employment Opportunity law, specially in the presence of the Diversity visa lottery.
I have pledged $1K for the lawsuit, because I believe in this just cause.
We need to find a good attorney to fight it - can anyone talk to the Big names - one name who sounds passionate in his posts is Ron G.
I have no big name lawyers around this remote interior place. I urge the folks who truly believe in this cause to:
- Talk to a few good attorneys
- come up with a plan for action and form an action committee
- Let the attorney determine the way we fund it ( A bare minimum $ amount be advertised), so that a conditional collective representation as well as refund clause is present in the agreement.
- We shall all collectively urge others to contribute too.
- If we do not receive the minimum amount by a certain date (say 60days), we would trust the Attorney to refund the cheque amounts as per the agreements we sign.
- It should not matter whether we win or loose. At least we would have stood for Justice and Equality for all.

Seems like USCIS worked over the weekend (TSC), my EAD approved on June 28 and my wife's on June 27. Our paper based applications received by TSC on June 4th.
Wife's Current Status: Card production ordered.
My Current Status: Approval notice sent.
I am not sure why status is different, any ideas?

This sounds unfair. Because of the backlogs, you have waited 6 years. Now you got laid off and you lost everything. Would that be the situation if there was no backlog and you were able to get your green card within, say 2 or 4 years?
I think those government agencies should take responsibilities and compensate for your loss.

IV is a voluntary organisation. You can request people to volunteer, but cannot force them or scold them for not volunteering. This is not professional. They might have their reasons and the right to work their way. I agree with your frustration when people who signed to turn up do not show up. But I feel this is not the way to express it.

For people to say they are coming and do not show up. I understand exceptions can happen, But least they could call-up and let the organizer know. I remember the same in recent Diwali Mela. Some who were supposed to come are still on the way.
This event was not to display the strength by show of hands. These members were expected to be delegated with some action items and follow up items. Either you volunteer or you don't. But volunteering and not showing up indeed speaks volume of the lousy character. Maybe this unprofessional behavior is commented upon strongly, but is it worth anything to sugar coat this behavior. Why can't we call a spade a spade? Just because it hurts? If we start accepting this attitude it only reflects a weakness on our side.
I see no reason why these peoples handle should not be made aware to other members at least at the state chapter level. Now they would know who they could count on. If I am a part of this team I should know who are in my team, who are accountable and who are not.

I remember in one of Dem party primary debates there was a related question on immigration (general immigration) - Obama answered that in positive way and in fact brought up the legal/employment based immigration issue on his own and mentioned that it needs to be speed up the process and make changes so that fresh talent is attracted - ofcourse at the end he added that american interests have to kept in mind while coming up with employment based immigration system (I remember gist of his response not the exact one)- but his whole response was very positive and if I remember correctly none of other candidates even mentioned employment based immigration - they answered generic immigration (meaning illegal) issue.
Does this mean anything - not much. As someone already mentioned both candidates are in favor of legal employment based immigration and increasing it to some extent - or atleast give some token support for this. But both of them may not take any active stand to make it a priority item - because there are other issues that people (their voters) care more about now like war in iraq, economy, gas prices, health care etc. etc. Both of them may not touch immigration until later in their term. Inevitably when they do touch it - it will be in the form of CIR and it will be big can of worms. Presidents can set the agenda and may issue limited administrative orders - but the expectation that either McCain or Obama will come out for EB community and unilaterally increase the quote or issue an admin order to solve our issue is IMPRACTICAL - and wont happen.
Our best bet is something to happen thru Congress. And our best bet is thru some relatively non-controversial bill like HR5882 (not CIR) - yes its a stop gap measure but it does solve many of EB issues until a new CIR comes into play. If you remember the golden days of EB in early years of this decade are because of a similar visa recapture in last days of Clinton administration - we need something similar.

This is like telling passengers to move to the other side of the boat when it starts sinking one side. The outcome is only making the boat sink faster. Remember, the huge backlogs are not completely due to unavailable visa numbers.
