I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.
People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.
I think the consulate officer should ask people that will you behave the same way at an US consulate??
People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.
The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.
We want the same level of professional at the Indian consulate then we need to show the same level of professional at Indian consulate that we show at US consulates.

To begin with there are tooooooooo many mouths to feed and people still dont realize the importance of population control:(:( Whe demand heavily outweighs available resourses then competition increases (basic to Darwinism). Primal instincts of survival come into play and behavioural modifications visible in the western nation are easily wiped off. Generally people have a desire that things be in an order but unfortunately due to the population stress prevailing in India, "disorder, corruption, favoritism" are the "order".
Will your generation be able to see this change? Possibly not?
Introduce the same stressors in the west and you will notice the same habbits surface here too. Natures way of dealing I guess??
One thing is for sure; If you practice non-violence in thought and action then chances are that your surroundings will ultimately reflect that same back to you. The way you react is most important than what the surroundings actually are. :D:D:D:D:D

Hi,
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.
Here are my questions.
1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?
2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.
3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.
4. Anyother suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

The term "Priority Date" appeared 10 times in last Visa Bulletin.
I wonder how USCIS is able to follow Visa Bulletin, without understanding this term.
I will contribute $25, if we decide to go this route. However I agree with all who say that we should ask them to make this info available periodically & REGULARLY (so that it does not end up like updates on processing dates)

Obama's lack of experience does not bother me as much as Palins because you have to see what people have done in whatever experience they have had. Obama did community service, has had a strong moral fiber in whatever he has said. Palin has already abused whatever little power she had. Being a senator Obama has atleast been exposed to world-wide issues. I bet Palin cant even locate Georgia on the map. Did you see her recent interview? In spite of it being carefully staged, see her stumble aimlessly when it comes to the question of the Bush Doctrine... The biggest foreign policy change this country made (decision to make pre-emptive attacks) and Palin does not have an opinion on it because she does not even know what it is. The interviewer had to tell her what teh Bush Doctrine is all about. Are'nt you scared of a person like that leading the US? Why does this country always pick screwed up vice presidents (Dick Cheney's approval ratings have been <30% for as long as I can recall)
Either way, from an immigration point of view (focus of this forum) we are screwed (see my previous post for stances of both presidential candidates)

Did he use that fiber to get rid of his constipation issues??

Kindly note that my suggestion to look for other opportunities is ONLY directed at youngsters in their early and mid 30s..not for people like you are me who are in this mess! i left UK and came here ...that was a GREAT and WISE decision!!!! ha ha ha !!! (Before leaving , I told my friends there ---> I am going for a great future...I am sure my friends are laughing at me now!!!) As I promised earlier I would keep you guys updated on the process of this case.
On saturday I received the welcome as a permanent resident to USA letter. After trying to get a hold of my attorney I got in touch with him.
Heres the story. (this guy is a genius)
I asked him how it was possible when my PD wasn't current I got GC approval.
His answer was funny and pleasant. Magic :D
He said after the approval of my PERM during filing I-140 under EB2 he also filed a petition under "person with extraordinary ability interest to US" on my behalf. So in other words both the petitions were being processed together at USCIS. Me not aware of USCIS rules wasn't aware of all the lingo so didn't know.
Now the Extraordinary ability petition quota is always current. So when my extraordinary petition was approved the attorney informed the USCIS that to adjucate my adjustment based on this approval. Since the PD was current for this category. USCIS processed and approved the GC based on that. I love this guy I don't have to work for my current employer anymore hence he will get a big surprise when I turn in 2 day resignation. HA...

Nice idea but does anyone honestly think the DOL cares. I am somewhat fortunate that my 2002 labor finally got approved in the middle of 2006. My son is not so lucky since he turned 21 while I was waiting. When my senators office took the matter of my son aging out up with the DOL I was told to put him on an F1 visa and send him to college so he can REMAIN (he wants to LIVE here, big difference) in the United States. These people do NOT care what they are doing to your lives. They do not care that my son has NO path to permanent residency any more and that I have to write the enormous check for his tuition twice each year so that I can still have him in the same country as me and his father. I feel awful for anyone still waiting for their labor certification but at least you will eventually get in line for your green card and will get ahead of those filing now with much later priority dates. You are indeed victims but I just wanted to point out that there are thousands of young adult children who have had their hopes for getting a green card totally shattered by this backlog center fiasco.

Called uscis and asked what happens to the app already received by them?
The rep put me on a hold..(guess went and asked somebody) and answered that all the app received will be put on hold(not returned) and said they will not process ead/ap too.Di anybody else tried calling and ask the same?did they tell the same thing?Just want to know if i interpreted it right?

It creates a parallel merit-based employer sponsored category without touching the existing merit-based self-sponsored category.
The merit based self-sponsored category is the crappy points system. This is in parallel to that, without touching anything in points system. They have created an exact parallel replica of today's EB1, EB2 and EB3 system with labor certification and the whole enchilada where you need employer sponsor and there is not points or anything.
EB1 = 33.3%, EB2 = 33.3% and EB3 = 33.3%. Definiation of EB1, EB2 and EB3 would be the same as it is today.
Total quota of 140,000 with automatic recapture of previous years unused GCs.
Exemptions for US masters and non-US STEM masters with have 3 years experience in that STEM field.The risk factor:
Now, the bad part ... the achilles heel of every high-skills amendment is the tethered H1B quota tricks. They are exempting everyone who has US masters or a non-US master in STEM from H1 quota, effectively making H1 quota = A LOT MORE.
The exact same radioactive provision for H1 quota is also in Lieberman-Hagel amendment 1242.
This will sink both of them unless either there is some inside deal going on that we dont know, or they strike out the H1 issue from this on the floor of the senate at the last minute and be content with H1 quota of 180,000.
the powerfull business lobby have clearly said that they wont support any bill that does not give a provision for us masters exempt. so if they dont get that the bill would sink as the senators supporting the bill cornyn are lobbying for the business community

Its not over till its over :), and its not over yet by any means. I am willing to wait and fight ;) . Everyone has priorities in life, each person would view GC situation differently. For me, its not the ultimate dream, but just a vehicle to continue my journey for some more time (with peace of mind). I am definitely looking to gray my hair in my home country or atleast be there once I am grayed haired :D
Doing an MBA/PMI and looking for managerial job is the only realistic possibility for most, I don't think most people would wanna still be programming when they turn 40/45 (depending on how old/young you feel).
My gut feel is that there will be some kind of relief by end of 2007 or early 2008

I cannot agree more with all the views. I have been here for over 5 years and couldn't find an employer to change to H-1B. L1 spouses can work and if the new immigration bill is passed a spouse of an illegal (who is legalizing now) via a low skilled job could also work, why can't we? We should have anyways.
There is a bill called TALENT "Through the Advancement of Legal and Educated New Talent.” which if debated and approved would let H-4s work, how can this be done?

First of all - THANK YOU. It's because of IV I am happy today with EAD cards on hand. I will never forget what IV did for me and thousands of GC applications in July. I can't forget the despair and the smiles IV brought back to our lives.
Probable reason - less motivated for couple of reasons which are already spelled out on this forum by others.
However I hoped to be part of rally towards the end. But couldn't. My parents came to USA last Friday. I did plan to combine my parents D.C tour with IV rally. Rally agenda - from the start, the D.C rally has not seemed need-based rally. San Jose rally and flower campaign were need-based. They were needed because USCIS ditched all July hopefuls. We were aghast and speech-less. So there was that burning-sensation in our tummies that took us to streets and greet the USCIS chief with bloody flowers!!
D.C rally has been strategic one. Somewhere in the beginning of the game, we pushed wrong buttons in marketing/selling the strategy or signing up people for the D.C rally. I remember very very few messages on the rally forums and tons and 100s of messages on "July 2" forum.
All senior fellows and the 1000+ members who made it to rally - have you surprised why there is NO 5000 - 10000 attendance.
Some more pointers to my thoughts -
> I can't associate all IV handles with real people easily.
> I don't know who is what (like in organizations we have people associated with certain responsibilities).
> Has anyone ever asked whether we should mention our association with IV in 485 application? And the repercussions?
Probable reason - less motivated for couple of reasons which are already spelled out on this forum by others.
However I hoped to be part of rally towards the end. But couldn't. My parents came to USA last Friday. I did plan to combine my parents D.C tour with IV rally. I think Both Sen.Obama and Sen.McCain are interested in legal Immigration. Mitt Romney was a big Advocate of legal Immigration. But of course, these are not the priority Items for both the candidates and also have to reassure the citizens that they will create new Jobs. Both of their plans will not affect Outsourcing
Sen. Obama Proposes to end the tax breaks for companies who outsource their work to other countries. This will not have any Significant effect on Outsourcing, as companies save much more by outsourcing , than tax breaks.
Sen. McCain already said that the lost jobs are lost, he will invest in re-training the workforce and find new areas of employment which cannot be outsourced.
I dont expect this Question to be heard in the forthcoming debates , as this Question was asked since the interview was conducted in Columbia Univ( University who supports EB Immigration)

Yeah there are tons of people who got their GCs with PD 03, but there are tons more waiting in 02 to get their GCs.
Sure there may still be 2002 files waiting but it is definately not a GREAT number. Here are three logical bullets to conslude that.
- Many people with 2000/1/2 dates have already left USA - Tired: Could not
take the delay:Found good oppertunity back home or elsewhere
- Black labor market played a part to shift a considerable load either to EB2 or
PD date from 1999/2000 and thus many people preferred that path either
stuck in EB2 or have already got their GC
The only thing we can be unsure about stuck in NC with those early PDs.
Having said this, it is ofcourse impossible to predict perfect chain of future flow, I see hope for EB3-I in this year, particularly last quarter at least for the people having 2004-Mid and before PDs.
