We have seen so much of visa retrogression all along.....I was thinking of the July fiasco...after effects....Just when i was thinking of How DOS advances the dates. It is really erratic...since they have no clue on the number of pending applications. While they want to advance the dates faster when they know USCIS will not be consuming all the 140K quota so they can have their overseas consulates process some of them in July it turned completely different More people opted for AOS v/s CP.... Wouldn't it make sense for them to have 2 different cutoff dates ?? 1 for USCIS and 2 for Overseas consulates . How will this help ? They can advance the dates more accurately. How does that affect the people already in USCIS queue...They can either choose to change AOS to CP. and since the dates are different on CP (better than that of AOS) this will make new people file more CP than AOS while a number of folks in uscis queue to move the CP route and hence relieve the pressure on USCIS. There will certainly be some disadvantages No EAD/AP etc when one goes the CP route v/s AOS but the wait will be minimal....

My wife is on her first year of OPT, she is masters in STEM so she is eligible for 17 month extension.
In-order to re-new her OPT she needs get herself e-verified. However, her employer said thay they are not registered for e-verify system.
My question is �
- Is it possible to renew OPT without e-verification, if yes how?
- What are options in that case if her employer does not e-verify?

I sent my 485 to NSC in July 2007 and got the receipt from NSC after 2 months. I filed my wifes 485 in first week of August 2007 to NSC but got the receipt from TSC. We live in Texas but our employer was from NJ when i applied 485. After that we have been applying for EAD and AP regulary at respective service centers with out any issues.
1. Has any one been in this situation and got their GC approved?
2. Do i need to request my wife's application to be moved to NSC if that can be done?
I am few days short of getting current and hope this doesn't delay approving our cases.

Hello Everyone,
My wife is trying to process visitor Visa for her parents and she has a problem with her mothers name in the Passport as it reads just the short name instead of her Full name.
I'm wondering if the Affidavit would be sufficient while going for Visa or would this still be a problem?
If affidavit is sufficient, can someone please kindly share the sample affidavit if you have one?
Appreciate your immediate response...!

My friend has his I-485 filed and has got EAD/AP, but the priority date is so behind, that he has no chance of getting a green card before his marriage. So, as I understand he should be able to bring his wife on H4 (as long as he maintains H1). My question is: does he have to re-file for I-485 to include his wife and if so will the priority date remain the same as the first application?She needs to file her own I-485 but only when PD become current. She has the same PD as primary applicant.

My Original PERM labor certificate was lost in mail so we filed my I-140 without the PERM LC and asked USCIS to obtain the certificate from DoL. USCIS got the labour certificate from DoL and sent the original LC to us as an RFE to get my employer's and my signature on the perm certificate. My employer by mistake signed the labor certificate where I was supposed to sign :(. We have now covered his sign with white paint and I would be signing at correct place and sending back to USCIS. Do you think any white ink or over writing on original PERM certificate would matter in adjudication of my 140?

I have changed from h1 to f1 in 2002, but did not apply through the mail in status change process, just took my I20 and got it stamped in a Consulate outside US (Mexico in my case).
So not sure, how the mail in status change would affect you if you directly show up in a US Consulate. It is probably best to ask a Lawyer.

Hi,
My company applied for PERM for me. Short of asking our HR/attorney everyday what is the way to check status.
Its applied just last week and but I can resist the urge to check the status already (anxious because I need H1B extension soon). Any advice is appreciated. thanks.

My OPT ends dec 08 and my H1 got selected in lottery but received RFE in Oct and case is still pending. Can I go for OPT extension right now as there is just 1 month time to file it?? Or should I go for premium processing of H1 and then go for OPT extension filing depending on H1 case result??
If I go for OPT extension right now even when H1 case is pending,
1)What happens to that OPT extension case if H1 gets approved?
2)What happens to that OPT extension case if H1 gets rejected?
Help me..

Will it be ok to change employers multiple times on EAD with in shrt span of time difference?
yes, after being a 'chicken' for so long, I changed job on AC21 six months back. And since then changed twice after that. (once forced due to economy, second time moved to a better position) in fact now I am loving the freedom that comes with EAD. Only make sure you stick to same profession (programming) other things like salary or job title etc doesn't matter. Good Luck!

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.
