hi folks,
I need some help wrt my wife's immi status.
She had applied H1 (from H4), and got the approval notice I-797.
Now, we applied I-485 for both of us on July 1st
But our attorney did not file for EAD/AP, because of time constraints.
Is it ok for her to start working using the H1 from Oct 1st?
Will it jeopardize her I485 Appln?
Any info / experience on this will be of great help.

Friends,
I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

I would appreciate some feedback on following situation;
1) My wife is on H4/EAD. She is beneficiary of my AOS application. She holds Master's Degree from US. What is the best option for her to work on?
2) She was on H1B from Oct 2001 to Mar 2003. She COS to H4 after her job terminated with-in weeks. Since then she's been in US (on H4) and never been out for more than couple of months. Can she apply for H1B and not limited to H1B quota and wait till Oct?
3) Would changing to H1B abondon her AOS?
4) Can she work on EAD now and switch to H1B around Oct time if she has to apply for fresh H1B for next yr quota.
4) If she can get H1B, can she still use AP for travel?
6) If i loose job or my 485 is denied, isn't it better she has H1B so i can get on H4 or on her GC application.

Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.

My husbands company has already started his GC process ( his labor n I140 is done)but my name isnt on his application yet. We are waiting for the date to become current n then my name can be added on is 485 application as his dependent. His PD is Aug 08.
Basically I was interested in knowing abt future based employment GC. Has anyone done that before?
Is anyone aware of companies who would be interested in doing it. I just need to buy like max 2-3 years ....just to keep my H1B extensions going. I like my current job so really want to avoid changing it unless there r no other options left basically.

The lottery program was established by the State Department back in 1990. Participation in the lottery has grown steadily as people in the developing word have gained increasing access to the internet. The month long enrollment period ended on November 3. Many people apply year after year since there is no limit on the number of times you can apply. The only rule is that only 7% of the winning applicants may come from any one country.

Hello.
I will be needing a new re-entry permit(i-131) while renewing my green card and i was wondering if it was possible.
I am going to study back in my home country for 4yrs.
first 2yrs(2010-2012), i am going back with reentry permit.
after 2yrs(2012), i am going back to USA for 6months to renew my green card(going to expire in 2012) and reapply for a new reentry permit.
If i wont have time to get my new green card, i am possibly thinking of going back to my home country for 5 months and going back to USA for 2 wks (to retain green card status) and again, going back to my homecountry for 3 months.
Would going back and forth to my homecountry and USA will affect me from losing my green card?
Any advise will be helpful. Thank you!

I have the following questions with respect to number of days I can stay out of the country for my situation.
I have been on green card since June 2010.
I have visited India from October 17' 2010 to Feb 4' 2011 (Total 111 Days).
Now I need to go back to India again for around 3 months (Approx 10th May - 10th Aug) which is about 93 Days.
My questions are:
1. As a GC holder can I make the above visits without resetting my 'Continuity of 5 Yeard of Residence' clock ? As in each calender year I will not be out of country for greater than 180 days. But, when you count from October 16 2010 - October 15 2011, I will be more than 180 days out of the country.
2. If answer to the above question is NO, do I need to file/apply for any exception to be out of country?

Because, if I go to https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.

hello all,
i m new to this forum. I know that when I-485 pending and EAD pending for 90 days, u can get temporary EAD from local USCIS office.
in similar way, can u also get temporary AP (advanced parole) if application pending for 90 days.

I have couple of questions regarding GC filing for future employment.
a. Is it legal to work for company B if one is working for company A and company A has already filed LC?
b. Any danger of getting audit because of multiple LCs?
