    Because you already filed I-485 before she turned 21, your daughter is protected by CSPA and she will get her GC as long as your case is approved even if she turned 30 before your AOS is approved (I sincerely hope you are approved before she turns 30 as she must remain unmarried until she gets GC).

    By the way, my son is in the same boat as he turned 21 in 2008 too.

    Hello -

    I am currently in US on L-1B that is expiring on June 15th 2010. I am planning to travel to India and return to US around May 10th. That will be around a month from the date my visa expires. My question is will I face any problems at the port of entry upon my return? I am needed on an assignment in US until Aug 2011 and so my employer is planning to file an extension as soon as I return to US.

    what happens if my previous employer cancels I140.

    I have a work related travel (2 days max) coming up in January. Do I need a canadian visa. I am on AP and my US visa on my passport has expired. My H1 is valid till 2009 (not stamped on the passport).
    My question is Do I need a canadian visa? Let me know if anyone had a similar experience.

    Hi Friends,

    I have approved I-140 (PD Sep,2007) but recently my H1 extension was denied so had to come on H4, so now what will happen to my GC, do I have to start from scratch OR my I-140 is still valid once I come back on H1 (with different employer).
    Please respond

    why was your H1-extension denied? If your employer supports, you can still file I-485 but he has to hold on to it till the date becomes current.

    Thanks for maintaining excellent site and answering all sorts of different complex questions.
    Now my story.

    I am going to apply in next H1B quota and was having below queries:
    1. I am confuse about what kind of h1b interview questions will be ask by consulate officer
    2. Will they ask my previous work experience letter.. because currently I am in Australia and my work experience was in India and there's no way I can have letter now.
    3. How's the job market for Enterprise Oracle DBA
    4. And Do I need to keep any extra precautions from start in order to be safe from all future legal problems being a consultant.

    Its not an issue. Make sure u fill all ur future applications like ssn, green card etc as per your passport. also ur birth certificate should be like ur passport details name date of birth and place of birth.

    Hi,

    Can anyone help me know of a process by which I can get my duplicate W2 form. The scenario is that I asked my employer to send me the W2 form and they say they did send it via post. But I did not receive it. Also my employer says they have not received it back. I need to file my taxes(Fortunately I had applied for extention) and don't have a W2 to attach with it. Can anybody help me with knowing the process

    Hi,
    I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
    I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:

    1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.

    2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.

    3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.

    4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.

    Am I missing anything? Thanks.

    Biometrics are not required for AP. You can paper file or efile - it is the same in the case of AP.

    My wife paper-filed her EAD and didn't have to do Biometrics.
    Will she have to do her Biometrics when she paper-files or e-files her AP?

    Anybody has any experience ?

    date: when your GC was approved (when I485 was approved). Place, usually you enter the name of service center that worked on your I485. For instance, Nebraska Service Center.

    Hope this makes sense.

    My attorney submitted at NSC I-485 , EAD , and Travel docs on 03 July, INS received it on 05 July, No news yet of receipt..

    Hi

    My friend was on H1B visa from last 5.5 years and Laid off last week .

    I want to know what options she has to stay in USA.

    from last company her labor and 140 was approved .

    Can she do visa transfer and start new labor ?

    Its only 5-6 months left in her 6 year h1b visa .

    Attorneys please reply .

    Are you the mouthpiece for your friend?

    Based on approved I-140 she can get 3 years if she is transfering the visa.

    Hi, I have a query regarding the opt to h1b process ,the answer means a lot to me.
    I am getting my h1b filed through a desi consultancy in the coming april in premium category.I am on opt and it has its validity till jan 2009.I will be giving interviews for a couple of finance firms in may/june in which i will most likely get one.now my point is i know i can change my job to this new company in june/july since i am on opt .I will take my h1b papers with me but come october i will get into h1b status.will it be a problem for me to remain in the new company which i shifted to, do i have to get back to my old company till i get atleast two pay stubs on h1b or is there any way to continue working in my new fin company without any trouble.the pay slips which i would have got during the months before i shifted jobs will they be suffiecient to get my h1b transfered to the new company.

    Gurus pls throw some light. it is really very important for me.
