What happens when a person takes a leave of absence and is out of the country? 140 is approved and I 485 is pending? Technically employed but not getting paid. My cousin is considering this as a possibility and is being overwhelmed with responsibilities in India. He was a July 07 filer, and his pd is Apr 02

I am currently working on EAD (thru 485), graduated in August 07, applying for H1B (first time) in April 08, my questions
1. Any effect on my AOS.
2. Can I start working without going ouf of the country once my H1B is approved on Oct 1st 2008.

On June 26, 2009, U.S. Citizenship and Immigration Services (USCIS) announced that the current edition of the Employment Eligibility Verification Form I-9 (Rev. 02/02/09) will continue to be valid for use beyond June 30, 2009. USCIS has requested that the Office of Management and Budget (OMB) approve the continued use of the current version of Form I-9. Once the extension request is approved, USCIS will update Form I-9. At that time, employers will be able to use either the Form I-9 with the new revision date or the Form I-9 with the 02/02/09 revision date.

My labor is approved in August 2007 and I have approved I140.It is likely that my company might declare chapter 11(bankrupt).I have not yet filed my I1485 yet as dates are not current for my PD.
My question is can I port my I140 to a different company B and extend my H1 based on the approved I140 from company A.
If yes, What documents do I need from company A to get this done.There were some posts which said I cannot port without having my 485 filed and pending approval for 180 days.is this true?
Can someone provide some suggestion what would be good approach.Ofcourse I will talk to a advocate before proceeding but in order for me to request my labor and 140 from my current company, I need to prove it to them that it is possible to port 140 without 485.

I have an I-485 filed under EB2 category and have used the Advance Parole documents to travel outside US. As a result my I-94 states my status as "PAROLEE".
I recently got my EB1-I-140 (Extraordinary Ability) approved and my lawyer wanted me to apply for a new I-485 saying that transferring a I-485 gets rejected more often.
However, on knowing that my I-94 states that I am a Parolee she tells me that she cannot apply for a new I-485. Is that true?
Urgent response will be greatly appreciated.

Hi,
I have an interview scheduled for my H1B revalidation stamping at the Mumbai consulate next week. My son will be accompanying me for his H4 stamping.
My wife is already in the US(she travelled using her AP).
The FAQ page of the Chennai consulate says that incase both parents are not accompanying the child for the interview, then the absent parent must submit a signed and notarized 'no objection certificate' to the parent going for the interview. There is no such mention on the Mumbai consulate FAQ page.
Question - Does this apply in my case - since my wife is already in the US ?

I have noticed that they have been given instructions not to give any information now due to the volume of calls HOWEVER if you keep trying you might get one person who is kind enough to answer your questions..
I tried 3 times (called with few days in between) and two time I faced pretty short replies with no help. But third time I got a very nice person who gave me more info. Among the few things I learnt were that they are still doing cases as of Aug 2006 and few random cases are being worked on dates after that. Details about I-140 will not be told unless you are the employer or the attorney. But you can ask about the status of your name check.

Your friend's wife should be okay. As long as the marriage took place before his I-485 approval he can add his spouse for an AOS or follow to join application even after the approval(within limited time window, of course).

If the H1-B came with I-94 attached to the I797 form, then your status would be H1-B from the day written on the I-94 form. From that day, you cannot work with the employer A without filing another H1-B with employer A.

I am renewing advance parole (i-131 form) for me and my wife. Can some one answer what the "class of admission" means on the form and how do we fill it?
I entered the US as H1-B but moved to EAD status last month.
My wife entered the US on advance parole and is currently working on EAD.
