I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.

Hi,
My friend has approved H1B with his previous employer and visa was stamped in 2006 in India. Visa is valid till end of 2009. He never came to US and he does not work for the employer(like Wipro) anymore in India.
Now he wants to come to US with new employer. What are the choices? As I know to transfer H1B to new employer he should be in US and with other documents like paystubs, SSN, etc.
I appreciate your response.

What is the point of publishing dates for people to see if they have no relevance?

Well, if you leave your co. now and also want your GC then:
Your H1 period will be over after 6 years irrespective of the I-140 from the old co.
GC: You do have to start from scratch.
However, you can still maintain your PD if your prev. co does not revoke the I-140. The documentation of your Old PD is to be attached with the New I-140.

When preparing docs to provide response for 221g form, I have filled DS-156 form at http://https://evisaforms.state.gov/ds156.asp. On click of Continue, it generated a PDF with randon bar code. Printed that online. And sent to docs to VFS Hyderabad officer.
I was told that bar code is wrong, I should fill up another DS-156 form. Are they looking for DS-156 submitted at the time of interview that has HDFC receipt number as bar code.
Please let me know if you have faced this problem earlier.
They have retained my wife passport asked to produce to copy of current visa of husband. Can I reply to this online.
Please reply ASAP

I think we need to expose employers who are taking advantage of us in different ways just because we are stuck with them due to retrogression. This way if we cannot change the legislation right away we can atleast scare the crooks by exposing them so that they cannot trap new people.

Some of my friends who are in their final year of a residency program on a H1b (non profit) have got job offers from profit organizations and their H1b transfer is subject to cap. Their transfer will be done only in May/June 2007 and now they are stuck because of the cap limit.
A lot of people in same situation are IV members. SOme organized effort is required to this cause.
These maybe people who could not file for their "real" jobs when cap was reached.
Must we not start an organized effort and let our law makers know about this situation.

Just want to know my options here and here is my scenario:
I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I don't have the copy of my I-140 but I think I can get it.

I guess you can, provided you gain the specialized knowledge during that duration (6 - 7 months) which you currently lack to get the approval.

My attorney just noticed that my company at the time of registering the PERM account accidentally listed the FEIN number of their sister company (with similar name) rather than the FEIN number of the company that filed my PERM and on whose payroll I am for the last three years.
Do you think this would be a problem at the I-140 stage since the FEIN number on the PERM is different from the one on the Form I-140 and my paystubs/ W-2? My attorney is telling me that this should not be a problem as it is a typo and he can explain this to the US CIS at the time of filing the I-140 or maybe we can stay quite about it now and will explain it to the US CIS if they have any questions about it.
I will appreciate your response to this.
