Hi,
My PD is 2005 and my I-485 was denied on the ground of my birth certificate and I got more proof from where I was born and submitted to USCIS and it was accepted in August 2009 and since then it has been more than a year and there is no update in the online status update for my I-485 application.
Lot of my friends from Late 2005 and early 2006 got the GC's last couple of months. I have requested my Lawyer to make a AILA inquiry? What else can I do at this point?

Dear forum members,
I have a question regarding transferring my H1b. My scenario is i am on my 7th year of my H1b and it is expiring on Oct 2007. My current employer will be filing an extension of 3 years based on my approved I-140 in the month of June 2007. If everything goes well i will get my three year extension(2007-2010) by Aug 2007.
Question is
1) If i get a new job opportunity after 3 year approval ( start date will be Oct 2007) can i transfer it to my new employer by aug or i have to wait till the start date of H1 approval?
2) When can i start working for the new company?
Any response will be appreciated.

Hi All,
One of the threads I read about requirements for I-140 smooth approval.
Please let me know
1.if anybody got any RFE's recently for getting I-140 cleared or processed. If so, what are they asking.
2. How important are salary slips in getting this approved
3. Are they asking for any recently pay stubs, if so, for how much period back in history.
The reason I'm asking this is sometimes we loose pay stubs, and hence I wanted to make sure I have all, in case any is missing.
4. Any risks in getting I-140 premium processed when dates are not close to current.
5. Any other risks.
6. How much time is it taking for regular I140 to get processed.
Any advice to this end is highly appreciated.

For those of you who either are residents (Citizens or PRs) or Canada or have been thinking about becoming residents of Canada but working in US, please share your experience in terms of:
1. How you maintain your residency (or non-residency) in both countries.
2. What are the tax implications if you maintain residency in both countries,
specially if you own property in Canada.
I have heard stories about tax implications in Canada if you own property there even if you permanently live an work in the US. Is that true? Would you be considered a resident in Canada for tax purposes just because you own property (such as vacation homes) but live permanently in US.

You should not be getting paid less than the prevailing wage, that's the important number. A $25,000 reduction is a lot, and suggests that the job has changed. If that's the case, the employer should have filed a new LCA and amended the H-1B.

Hello everyone,
Few weeks ago I had filed my wife's H-4 through my H1B. We have already received the receipt for her H4 filing. The H4 has not been approved or for that matter denied. She got a new job and she needs to start in few days. She intends to use the EAD that she got from our I-485 filing. She had never used her EAD before.
The questions I have is -
Do I have to do anything to notify the USCIS or let it be?
What will be implication on her H4 petition, will that be denied because she used her EAD?
Any suggestions would be greatly appreciated.

Your company's HR/legal should be able to give you an answer on how to reply to the NOF. I think they just have to show that they need you in the location that they put on application. Just make sure that EVERYTHING on applciation pertains to that same location - i.e market wage rates etc etc. If for some reason they do not have experience in these matters, try and get a hold of that NOF and go see a real lawyer. And word to the wise - be prepared to pay a little for the advice that you get. You always pay for what you get- so don't go to some 2-bit lawyer who will charge you $100 for answering questions when you can pay $200-$250 for someone who will give you worthy advice.

I am currently working for Company A on h1b, expiring on May 31st 2010. The GC application is denied based on on A2p issue with company A.
I had company B already filed for my labor in 2008 and approved in Jan 2009. They also filed concurrent 140 and 485 in March 2009 which is still pending. Company B wanted to hire me and now its time that I move to company B. I do have latest paystubs from Company A, currently valid i797 and experience letter.
can I migrate to company B by transfering my h1b based on approved labor with company b and pending GC application. What documents are required to transfer.

Is it possible? Pro-active Finger-Printing without appointment letter.
I have done my FP on March 1st 2005, since the validity is now expired, i called the VSC to enquire when and if i will be getting another FP notice soon.She told me that i can contact the local ASC(Application service centre) and go for the Finger-printing without any formal Notice/Appointment Letter.
Has anybody done this? ie has anybody done Pro-active finger-printing without appointment letter? Please reply.
