Senators John Kerry (D-MA), Richard Lugar (R-IN) and Mark Udall (D-CO) have reintroduced the start up visa bill now that the new Congress is in session. The bill would grant two-year visas to entrepreneurs if they secure $100,000 from qualified investors. After two years, the start up must have at least five employees and $500,000 invested. Democrats and Republicans have talked endlessly that the focus in Washington should be on job creation, but for the most part little has been done. The start up visa is a way to directly create jobs and costs the taxpayers nothing.

Do my employer need to file I-140 within 45 days of labor certification? Is this a law now?

The Comprehensive Immigration Reform bill introduced in the House of Representatives would revamp the existing employment-based (EB) preference system in a number of important ways: 1) Recapture � Currently, 140,000 persons are permitted to immigrate to the U.S. each year under the EB preference system. If less than 140,000 visa numbers are given out by the end of the government�s fiscal year on September 30, the remaining numbers are essentially thrown away. hi there,
i'm planning to bring my in-laws to USA and they have their visitor visa appointment next week. everything is set but i'm a littled worried about demonstrating financial stability to sponsor them.
i have paystubs & employment letter but the bank letter doesn't look so good. i live on check-to-check and my current balance is around 3K. you think i should take chance and go for the interview and hope VO doesn't ask for bank letter or doesn't mind the balance?
please help. any feedback is greatly appreciated.

Great news! The Hatch widows bill (which removes the requirement that a couple must have been married for two years before a US citizen dies) passed and included in that bill were provisions extending the religious worker green card program and the Conrad 30 J-1 physician waiver program. Each of these programs were extended for three years. The EB-5 regional center program for immigrant investors was permanently reauthorized by the Senate yesterday. The House must agree to these amendments before they go to the President and I do not yet know whether the bill will go back to the House...

My friend John Lamb in Nashville blogs today about ICE's Hutto detention center where whole families are jailed while awaiting deportation. I'm reminded of Charles Dickens' tales of debtors prisons in Victorian England where "lawbreakers" who violated British laws relating to debt were jailed right along with their spouses and children. It's hard for me to tell the difference. I don't know that I blame CCA, the contractor that runs the center. Nor do I necessarily blame ICE which is simply carrying out their mission. Hi,
I�m currently on H1B, I'm planning to go back to my country for an extended period.
Few queries
1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
I may go for six months, year or more, depending on circumstances.
2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?
If someone could answer my queries and help me decide, it will be very helpful.

Folks,
My wife got terminated on Feb 13th, she received her last pay stub on Feb 20th...We haven't applied for a COS till date...Is she now out of Status..??? She was waiting on her last paystub before she can apply for a COS and she received around 24th of last month and now we are all ready to send our documentation for COS to USCIS. During this span of 2 weeks is she considered staying illegal here..??
I was reading somewhere if USCIS receives her COS after her employer h1b revocation, she might be denied her COS...Is this true...??? Please Advise.
I was also reading somewhere about e-filing for COS, is e-filing available for H1 to H4 COS..??

Friends,
LUD on my I-485 (TSC) had not changed for the last two years and I now find a soft LUD of 09/15/2009. Has anyone experienced recent LUDs on their pending I-485?
I am asking because I am wondering whether USCIS has really 'touched' my file or if this is just a regular 'batch update' that happened to all applications, may be because of the new website migration.
Appreciate your answers.

My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?

Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.
