If this bill pass without our provisions in it lot of us will be doomed!!
If the bill passes then obviously they have to look into people who are stuck in labor in BECs right. Look at the labor substitution elimination rule it will go into effect from July 15 and its still 1 1/2 months. Also it gives relief to people who havent applied next stages although labor approved and whose labor is to approve.

Guys,
I applied AP in Jan 4th 2008. Last week on 13th there was a LUD on AP. Today the status changed to "Document Mailed to applicant". Based on your experiences does this means RFE or Approval. BTW i belong to Nebraska Service Center.

I believe that means the AP is on it's way. And you had a superfast turnaround time! I applied for AP on November 6'th, and my status changed to "Document Mailed to applicant" on March 17'th. Nebraska certainly seems to have a sort of LIFO policy rather than FIFO.
I still haven't received my documents either. I will wait a few more days before bugging my lawyer.

Having committed no crime, they have to notify the government every time they change their place of residence � something that, among American citizens, only convicted felons are required to do. They have spent hundreds, sometimes thousands, of dollars on government-mandated application fees and related costs. They have underwent inordinate amounts of stress making sure their applications were complete and properly filled out in every way, knowing that any error or omission, real or perceived, could get their application automatically rejected. Through it all, they had faith in the system of legal immigration. Now they are being penalized for following the law and for having faith in the system, because the federal government has dealt with them unjustly and deceptively. I request that you investigate and work to improve the procedures for legal employment-based immigration. NSC --> EB2 I Oct 2006 -->485 June 2007 filer --> LUD on mine 03/03/2009 --LUD and RFE on my wifes 03/04/2009 (RFE email from USCIS says: Current Status: Request for Additional Evidence Sent not sure what it evidence they need, recently we have made name change amendment on EAD for my wife, I am assuming it should be related to that, will wait and see till we can hard copy of RFE)

Looks like my employer will fill up the 7001 form but how about the main letter. Does that needs to be signed and addressed by employer as well ?
Because the Link for 7001 doesn't talk about sending a separate cover letter.

My application was sent on June, 14th and delivered on June 15th (I have the FedEx tracking info and signature page confirming 6/15).
The case status online based on receipt number (obtained by calling them a few times until I got lucky) says:
"On July 11, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case."
Not sure if the online status is referring to the receipt date or the notice date when it says "On July 11, 2007, we received" when, in fact, they received it on June 15th!!

I reviewed my comment and I haven't wrote anything trashing another country and I didn't say that USCIS is bad. In fact, if you read carefully I am trying to defend USCIS from "Mirage's comments".
I don't know what nationality you are, but, I am an Australian and I don't need to suck up to get my green card. I will get my greencard soon, probably sooner than you.
In fact, there is a special immigration program "only for Australians" that allow me and my dependents to work and live in Australia indefinitely. That was signed in to law by the President last year, if you didn't know about that. I guess you got me wrong. Australia and America have good relationships as you know.
I still would stress to thank America for giving me the opportunity to work and live and experience America.

Though I visit the forum quite often, I do not particiapte in a big way. I just read to understand the view points of others. After a lot of hesitation I took time to draft this note!
I am not sure how far my views would find acceptance, but I would like to share some of my thoughts!
1. Although I would sincerely like to give credit to the IV forum for all what they have done (and doing), I personally feel that that the days of prayer and petition are gone!
2. To achieve something concrete and tangible, atleast a minimum of 100,000 (Desis + Chinese / Filippinos if possible) should rally in Washington DC to press our case.
This alone will generate enough publicity. We can show our strength and if there is a consensus, opt for a hunger strike.History has always shown that "direct action" alone has yielded results.
3. Unlike European countries where the laws of immigration and naturalization are simple, here it is very convoluted and confusing. All laws in the USA ONLY favour the employers and the law firms. Due to this, several of us have been harassed by our employers.
4. Instead of harping on the existing archiac and immigrant unfriendly rules, we could propose something like this:
a. Provide Green Cards for all legal immigrants who have completed 8 years of continuous stay, as on say, June 1, 2010. Continuity would mean not leaving the USA for a period of 90 days at a stretch. (I have completed more than 9 years personally, but I am suggesting a time line of 8 years because H1 is valid for 6 years and L1 is for 7 years. It will certianly not acceptable for the US Government to provide GC to every H1 / L1 holder. Any period below 8 years may meet with very stiff opposition)
b. The legal immigrants with 8 + years should have a criminal free record (barring minor traffic offenses) and should have filed their tax returns
c. Citizenship status should be provided to all legal immigrants with 10+ years
Note 1 : Rules in the UK/ Europe are :
Permanent residency after 5 years of legal stay
Citizenship after 10 years of legal stay or 15 yearls of illegal stay
5.We are always getting drawn into the trap and quagmire of the existing regulations and the INS / US goverment / Law firms / Employers are enjoying the fun
Note 2: I have stated everything based on my stay in different countries and keeping in mind the interests of the immigrant community very sincerely. It is upto IV to publish this or discard this. I will also NOT respond to any comments / cristicisms. I am just requesting the readers to kindly intrsopect!

Hi,
Does anyone has recently got I-485 approval after porting priority date from earliar EB3 filing.
My I-140 got approved 2 weeks back and based on priority date, I am current. Ny EB3 485 was filed in July 2007.
How long it is taking for I485 to get approved after I-140 approval when the priority date is current.

Filed my first GC in 2001, didn't go well (3-year degree issue). Refiled in 2004 and waiting ....13 plus years since landed in US (1997).

When you are working for a large(r) corporation, where all fees (including EAD/AP) are paid for by the company, who pays for the MTR?
I was under the impression that the employer pays for the filing, attorney, etc. fees, am I wrong?
Depends on ur employer. Usually after AC21 - it is obvious that there is no fee involved and many companies hire you after ac21 because they do need to deal with stuff like this.
Your employer ONLY needs to give a letter as per the AC21 rule and thats it.

My labor was approved 8 months ago. Although i submitted all the documents to my attorney 5 months ago My employer is yet to file. the fact is i am eligible to file for 140/485/ead/ap. So now i am stuck. Will this affect me.Thanks in advance.:mad: :mad: :mad: :mad: :mad:
