Hi.
My Wife is currently in H4 Visa and in US now. She has total of 11 years IT experience. She lastly worked with a Company X from May 2004 to May 2008 for about 4 years. Currently she is not an employee of Company X and also not working anywhere.
If the same Company X gives an US offer, Is it possible for the Company X to file L1 visa for her so that she can start working for that company immediately ? ( I have read in immigration forums that the L1 Visa Eligibility is that the person should have worked for that company for atleast 1 year within the last 3 years)
Experts, Can you pls give your opinion and suggestion on this ? If so, how long the process takes place for transfering from H4 to L1 visa ?

I had been in H-1B status and was laid off. My H-1B was withdrawn by my company on 12/31/2010. I applied for COS to B2 and received the USCIS receipt notice on Dec 17th, a few days before my H-1B was withdrawn.
Later on Feb 2nd, 2011, I received the approval notice from USCIS for B2 valid from 02/02/2011 to 04/29/2011(I had informed in my application that this would be my date of departure.) My question is: What status would I be from the date my H-1B was withdrawn till the B2 validity start date?
Forum members, please clarify.

I am trying to get I140 approval notice using FOIA G639 form. While filing this I have all the info but one section asks which document I am requesting and other info like location of that document.
How to know that. My I140 receipt and I1485 receipts start with SRC. Does this mean that I140 approval notice is also at Texas Service Center. With all the bi-specializaiton mess I forgot how things are now (where is I140 processed). If anyone have more thoughts please let me know.

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or

The Center for American Progress has released a report that urges an end to the "arbitrary restrictions" on H-1B visas and replacing the 65,000 quota with a market-based system where numbers rise in a strong economy and drop in a weak one. The report also recommends stronger enforcement mechanisms to prevent fraud and abuse.

I was searching on all programmer salary's on SalaryList.com (http://salarylist.com), it looks like we are much higher than the other majors, business analyst, finance analyst. So if I want to do AC21, in current condition, should I keep same salary? Several companies I talk to can only match now

I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. And since then I've noticed that when I do presentations for civic groups or have observed focus groups on immigration, the older attendees seem to be more hostile. Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.

My understanding is, you don't have to. AOS is a valid status until there is a yes or no decision on your 485 applicaiton from USCIS.
