USCIS to Issue Two-Year EAD for I-485 Waiters at End of June 2008
The Secretary of the Department of Homeland Security announced on 06/09/2008 that the DHS would start issuing two-year EAD beginning from end of June 2008 for the I-485 filers. Hooray!
Announcement: "I'm also pleased to announce that we will be extending the validity period of the employment authorization documents that we issue to individuals who are waiting adjustment of status to lawful permit residenture or in colloquial phrase, the green card. Currently, adjustment applications are granted employment authorization documents with only a one year maximum validity. Beginning later this month, we'll start issuing these documents with a two-year validity period for aliens who are waiting adjustment of status if their application is expected to be pending for more than a year. This, again, is eliminating a persistent source of frustration for workers who are here, who have a pending adjustment application but have to go and renew their employment documents every single year. I am confused about receipt date?
Is receipt date the date when they do data entry into the system or is it the date when they receive the package even though they may do data entry a month later?
My application was sent on June, 14th and delivered on June 15th (I have the FedEx tracking info and signature page confirming 6/15).
The case status online based on receipt number (obtained by calling them a few times until I got lucky) says:
"On July 11, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case."
Not sure if the online status is referring to the receipt date or the notice date when it says "On July 11, 2007, we received" when, in fact, they received it on June 15th!!

To summarize the root causes now that we discussed:
1. Parental interference to control their own child even after marriage. This is cause no 1 of this kind of tensions.
2. Immaturity on the part of children, to let their parents control their feelings. (This is partly due to in arranged marriages, children are closer to parents than the spouse in initial years). This is no 2 issue. Children simply fail to understand they are no more part of their parents family. I honestly feel these people are not really ready for marriage or understand what marriage is.
3. Money transactions. One side expecting money from other side which is not really acceptable. I will elaborate this point a bit more.
4. In cases of couples settled in US/UK, parents know that couples are making a LOT more than by Indian standards. Hence to secure their own old age comfort, everyone tries to exert influence.
On no 3, let us separate our "legal" obligations from "moral".
Morally it is right to send money to parents, but legally it is not. As you can strive but, you wont be fair to either set of parents. Hence I believe "money" should not be sent to parents. Your parents should have planned their own future, including humanitarian needs. Only if your other half agrees, then only you should send money. Otherwise, it is your and your spouse's money.
If your parents needed monetary support then that they should have made clear to other parents at the time of marriage. Not after marriage. If its a love marriage, then the boy/girl should have clearly told this requirement to the other half.

There are ton of companies that you can go thru. My case was worse than yours, I am on EAD with expired visa. I already had a house on which I was trying to get the loan modification and when going through that process my credit was screwed up. There was no way I could have got the loan from BOFA or chase or any other big names. I went thru a very small loan servicing company who service the loan and make a portfolio of loans and sell to big banks. Even with that small company it was almost impossible but my loan officer got it thru and finally we moved into a new house then.
So bottom line , kick the lame a** loan officer and look for someone else.
Thanks sy. I fully agree it's the agent we deal with. My BOA loan coordinator is extremely stubborn & doesn't have any clue regarding immigration. From day 1 she is stuck on unexpired I-94 & till today she asks me to furnish that. Is it possible that I can contact you or any of your friends through email / phone & discuss to check where I am going wrong. I can furnish my contact details if needed.

Assuming the possibility that PD will be "unavailable" for the next few months at least, then on what basis do they allot visa numbers . PD or 485 receipt date
I believe Visa number is allocated only at time of Adjudicating i.e once everything is clear. At the time of adjudicating your PD should be current & you should be ahead of others per RD.

Coming in through H1 does'nt show your intention of becoming a permanent resident of this country. It only happens when the LC is applied. Although the entry date is an ingenious way, it will only create more issues. Now some one who comes in F1 can also ask for the same benefit when they move to H1, to take their entry date in F1 as their priority date. I believe the culprits are the labor substitution and the labor certification sales. Those are unfair. Stop labor substitutions, and if they need one, then use the 140 RD as the PD. That should solve most of the problems and people from using labor sub to jump the line.

We have many people who are pretty knowledgeable on matters related to AC21 (like chaduv) who might be able to answer them. If it is something about this campaign and have questions - please shoot, will try to explain why we are considering it is a serious one and can affect anyone.
Everything related to EB immigration is grim for last couple years - the only two things that made some positive impact on us are July 07 fiasco and admin reforms. IV made great efforts to achieve them against all odds (just like RedSox win yesterday :)) - those two combined with AC21 regulations provided many of us the flexibility and career advancement that we missed because of this cesspool called GC. Now that flexibility is at stake. What is the use of AC21 regulations and EAD if we are not certain about whether our I485 will not be denied later.

First of all - never assume your I140 will not be revoked - it can happen in many circumstances even if you had good relations with employer. And even if you are not planning to use AC21 right now, think about this: we are all in this together to make EB immigration better. When things are tough to make any change (legislatively or administratively) - we cannot afford to lose one of the very few positive things that happened to us. IV core fought for us - spending their time and even money - lets take some inspiration from their acts, and show them that we volunteers are serious when we say that we want to contribute to IV and make a difference to EB laws or USCIS functioning.

1) this labor might have been approved from one those states which had fast approvals was able to able to apply for concurrent filing before jan 1st, 2005 when EB3 retrogressed.
2) since there were very less cases between 2003-2004 in I-485 (due to slow BEC processing), this particular case was selected based on RD.
3) but with the current openings, there will be a lot of cases between 2003-2004 enough to use up the numbers esp for india until the next several years.
So i dont think we can guess that the I-485 dates will now be at 2005 or later.
