I thought I should mention that I got my AP papers on May 22, 2009 that is just under one month after my application (4/24) and sending them a letter with following documents �
1. Bio metric page of Passport, (I guess photo copy of drivers license is also acceptable)
2. I 797 action notice for your 485 application to prove your 485 is pending
3. Two passport size photos
4. Confirmation receipt received after e-filling for AP.

Should we send letters to the president about EB india category. The dates are moving very slowly..... etc..

There was an IV campaign for writing letters to the President. The deadline was March 11th but I presume you can still participate by writing the letters for admin fix. Templates are on the main page.

As far as I know, if one goes to UK on a work permit, the spouse can start working from the beginning itlsef. The professional and the spouse get their automatic PR in 4 years just by being there. There are similar examples in other countries, but, the fact is that if we have to be in the US, we have to go by "their rules".
I admire US administration's guts to openly admit and declare that they are biased and work on a case by case basis or at will when it comes to looking out for their own interests, even in the immigration (Not to mention, they look confused as well).
For example, how is a spouse of an L1 visa holder anyway different from a spouse of and H1 ? The difference is that the US government presents the L2 spouses with an EAD at arrival and restricts the H4 spouses to home.
Well, I think we should take one thing at a time, and the current task in hand at IV is more than enough to comprehend and fight for, adding the H4 issue eventually may add value, but not at this juncture.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

EB3 vs EB2 classifications depend on Job Description ie the description and education, experience requirement given at the labor certification stage.
You can get labor certification which would satisfy EB2 class requirements and apply under EB3 for I140 .... but not the other way around. ...
That means starting from scratch with PERM with a new Labor... loosing PD and back to square one ... obviously not worth it

Its good that we have a democratic majority in congress. we also now have work cutout for us to contact new lawmakers. getting more members and members willing to work for local chapters is important at this time. we need to work with renewed vigour now and finish our task. pls help with increasing membership and join your state level chapter threads. I see only very few members have posted their interest. we need interest from each member in order to succeed. I am sure we will succeed. The good times are ahead of us but we need to take advantage of it.

I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005
This is not how you should have said, delay EAD for others just because people are struck at BEC. Comeon buddy show some wisdom, you should have said USCIS come out with a plan where as soon as BEC labor is cleared, they accept the applications for 485.
The reason i said that: the manpower/funds that will be spent on the 1M+ EADs can be made available to BECs (if possible) and get the BEC job done quicker. EADs will be delayed only by a few months. Also don't forget the "OR..." part dude.

Good post. Politics is a game of give and take. One thing legal immigrants should learn is not to distance themseves too much from the cause of illegals. If we support DREAM act, they will support SKIL bill. If we support admission bar repealed or 245(i), they will support higher numeric quotes and not counting of dependents. Think about it, our common goal is the same - to have a fair immigration system, where every desrving person has a chance to come to this country legally and with dignity.

Look at the unity in our diversity...for a moment while reading some of the comments I forgot I was in the US and looking at an supposedly elite forum...Bravo!! Keep it up Indians (Tamilians, Gujaratis, Marathis, Bengalis, Biharis, etc..)
One more thing, if you are upset with a person who misbehaved with you (in this case, rudely told you he didn't know any language other than Hindi), then logic tells me I should be upset with that person and not the reason (in this case, language) itself.
I belong to a Hindi speaking part of India, and I have lived in Pune, Bangalore, and Hyderabad. I've had people tell me very rudely to talk in the native languages of these areas and I've tried, sometimes successfully and sometimes, not so much. The rudeness of a few members of the community never led me to form a general opinion. I've very close friends from all over India.
It is my opinion that one should try to learn the local language. It bodes well for everybody and makes life easier. As matured people that we are, I think this is a very trivial issue to fight among ourselves or get emotional.
I never knew Hindi is a local language in US:D Moreover I dont have anything against Hindi or any other language. Its the personal experience with people on more than one occasion.

I am not sure about the statement "There is no corporate support for EB reform.....". Check this link http://www.competeamerica.org/. They seem to have the same agenda as ours (i.e., IV's). Is IV aware (or in collaboration) with them?
competeamerica is just doing lip service to the EB. Their real agenda is more
H1B. When time comes to compromise they will gladly sacrifice EB reform
for more H1B visa (mark my works!!!!!)

Taking courage from the responses of this forum I e-filed for AP today and got an exact reponse as you mention below.
Did you get your AP? how long did it take? Did you send 'Confirmation Receipt' as mentioned in the pdf file after submission? Did you call USCIS for any issues?
Would highly appriciate a feedback on the process.

I e-file my AP and I got receipt notice immediately after completion of e-file. And I got the direction on the PDF listed bellow. USCIS clearly mentioned DO NOT send Copy of ID, Photos unless they requested. That�s why I didn't send any documents to USCIS.

The attorney i had was Jeffries expensive but good.
I have a BS in biology and computers (was on F1 visa)
Then I did research on cancer cells at the university while trying to get into Graduate school. Got my MS in information Science and also an MBA.
For MBA I did my research on Economic growth and Military spending.
After MS i got job h1b for a research facility was doing mba at the same time. Switched employer to work for a multi national corporation. Quite my job for multi national because they would not apply green card started work for a consulting body shop they apply for my green card.
Now Soon I will give my resignation.
You really have a great lawyer to pursue EB1 while your EB2 application is in process (that too without even requesting) .... I almost cant believe that there are such lawyers in immigration field. Congratulations and have fun.
As an aside I will tell my story - have couple masters and a PhD with several publications. My EB2 thru employer is pending. I requested (actually begged) my employer and attorney to pursue EB1 as well - they said no - lawyer's response is EB1 is very difficult and you should be someone of nobel prize calibre etc.etc. I tried convincing by giving several examples of my friends/classmates in PhD who got approved with fewer publications/patents. The lawyer got irritated (maybe because I am providing info that he is not very well aware of) that I am actually giving suggestions and he and HR indicated that I should be happy that they are sponsoring me for EB2. I went ahead with another private attorney to submit another EB1 I140 separately which is still pending. EB1 needs lot of paperwork on our own and needs employer assistance in providing solid proof that work is of high importance - I didnt get that assistance so not very positive about EB1 approval. For now just waiting for my EB2 PD to become current.
I am telling this story because my experience with immigration attorneys is generally bad and its same with scores of friends so much so that I am convinced that immigration lawyers may be one of the least competent professionals in US. In US customer satisfaction is everything in almost all professions - customer is god because he/she is giving us business. But in immigration lawyer community - the end customer may not be the one who is giving them money and even worse the HR people in companies (even the best ones) are either ignorant of or scared of immigration laws and just defer everything to lawyers who kind of exploit this situation. So if you come across a good immigration lawyer please say thanks to him/her on all our behalf.

What an absolutely useless discussion! EB2 and EB3 are based on each employer's attestation of job/work requirements.
Obviously, there is little correlation between book knowledge and real world results. Highly educated lawyers and Top B School MBA's can be found stuck in dead end jobs or suboptimal careers while barely educated street smart folks can be found enjoying productive careers.
So, let us stop this nonsensical analysis about something that adds ZERO value towards the core mission and objectives.
Lets use those 'high skilled' grey cells for something that matters. Stay away from the keyboard if you cannot resist the urge to puke over it with your fingers putting forth filth.

Between my side i sent letter to president and requested 10 of my friends to do so..

when meetings take place on such issues, it's important to carry the large number of petition letters along...it has an important impact.
please do mail copies to iv also- can put them all in one envelope and send.
i have about 30 letters with me now (including 6 from another MN chapter members), many more are still in the works and i have friends working on it too...
