We have seen in the past years EB3 ROW got huge visa bonanza at the cost of EB2 I & C. And now apparently EB2 I & C is getting rightly deserved visa bonanza.
How about asking DOS to give similar visa numbers to EB3 I & C as a one time exception. I know people will say it is against law, but in my opinion law is fuzzy enough for this to happen.
DOS can give explanations like "Visa numbers will be given to oldest PDs or some thing". Per my calculation EB3 I needs 68K visas to move past 2003.
We (IV) may have to make representation to Secretary of State and try and convince her.

Why do they need money to respond to RTI request. IF they don't have a program, its their job to comeup with one. They shouldnot/cannot go asking for money.

First thanks to those who put there first hand experience in this thread, it made me think again. And now I am deciding to cross the border and go north, after 9+ years in US on H1b.
Could someone please refer a Do-it-yourself kit that they have used and/or immigration consultant?
I contacted one consultant, they email almost every week and when I called/emailed them saying I am ready to pursue there has been no response from other side yet.
It will be great help for me if you could refer a kit or a consultant.
Looking forward to join H1->Canada community :D

This is a basic supply and demand issue.
When H1-B yearly cap is getting used up within days, what is the reason for allowing H-4 to work.
The only way you would see a change in the rule is when there are not many H1-B takers, and they need to attract more families.
Don't get me wrong, i am not trying to say H-4s should not be given the oppertunity. Just think in terms of the need for this country. Not our personal needs.

Stop amaturish and derogative remarks all the time to forum members. If you feel, I am contributing only after I-485 measures failed then its your mind-set problem..also, will you shut up and mind your business?

I agree with your message of unity, but that should hold good at all times, irrespective of whether you agree and do not agree with IV. People holding off contributions, heckling IV, questioning IV rationale when they don�t agree with IV is outright selfish and should be avoided at all times.

I have made a post. Please confirm if yours was exactly the same case " subsitution"--leading to 2 applicants seeking same labor and me being left with no I140 since previous employer revoked.
Based on your post, I am hopeful that my MTR gets accepted too. Could you answer the other questions I have raised that relate to post-MTR phase.

Exactly my thoughts - we should try our level best to get one of these bills passed (Specter or Frist) with our clauses in it.
1. AC 21 clause reinstated or atleast have a fair distribution policy
2. I485 filing after a certain wait time.
If none of these bills pass this year, there is a chance we will be stuck for a long time in BEC/140 stage.

I am wondering your logic for using "desi lawyers". They graduated through the same system as any other "book smart" attorney in the "smart" fragomen system. I think it is always a negative to go through a large law firm. An association with a large firm must not be confused with efficiency. Who knows...might be freebies which they provide to HR grp of the large firms keeps them in the picture.......................
I agree with you. Even we have Fragomen attorneys and I did not find them any great. So far I have not had any bad experience with them but they screwed up one of my friends GC and now that person has to leave US.

I guess this is the best thing to do, to upgrade my current EB2, and apply for an EB3. I hope this will expedite thins around here. Looking forward to more good things come.
